The answer here is obvious - the management company should be engaged in the repair of the facade. However, this is where funding is difficult. As a rule, the company starts collecting additional funds, in addition to regular payments, or increases its tariffs. Does she have the right to do this or not? this question is often asked by our clients, so we decided to clarify the situation.

To answer this question, you need to study the Resolution of the State Construction Committee of the Russian Federation No. 170 and the Appendix to it. What does this Resolution say?

And it says that the company must carry out repair work after the general meeting of the owners, provided that the necessary work is indicated by Regulation No. 7. So, if it is planned to carry out, repair the facade or paint it, restore any architectural elements of the house or embed them, replace sections of wood cladding.

There is one more Appendix to the Resolution (No. 8), and it contains a list of works carried out during the repair. These include the restoration of any elements of the building, its insulation, the installation of triple glazing, the arrangement of external vestibules in the house.

Thus, all these types of work are carried out by the company without fail. Provided that a meeting of tenants was held and the cash desk has the necessary funds.

However, there are cases when a company has to complete work even without a meeting, regardless of whether there is financial means. What are these cases?

Distinguish between maintenance / major repairs and troubleshooting in the house. So, if we are talking specifically about troubleshooting, then it is mandatory, it is possible without a general meeting, and without collecting additional funds. Moreover, the management company must fulfill the tenants' request within a clearly defined time frame (from 1 to 5 days).

What kind of work is done on such terms?

First of all, this is the restoration of brickwork - when the mortar has crumbled, and individual bricks can fall out of the wall. Also, this is a violation of the density of the flue or chimney, or the places of their connection with the stoves. Work is also carried out in cases where the plaster peels off the walls or ceiling, and there is a threat of collapse of its pieces. The same applies to stucco, wall cladding or façade.

All these works are carried out at the first appeal of tenants, and if the management company does not respond to the appeal, tenants can (and should) contact either the prosecutor's office or the housing inspectorate. You can also go to court - if the company ignores the decision of the housing inspectorate / prosecutor's office.

In court, the prosecutor's petition was satisfied: the management company was ordered to carry out restoration work (restoration of the facade cladding due to plaster peeling), however, it did not complete the work.

During the trial, the company argued that it ignored its obligations by the absence of a decision by the general meeting. However, these arguments were found untenable, since, in accordance with the law, the absence of such a decision does not give relief from obligations, in this case, for the maintenance of the house and its timely repair.

The court indicated that all the requirements for the maintenance of the house are determined by the Rules and Norms for the Technical Operation of the Housing Stock, as well as by the resolutions of the Gosstroy of Russia dated 27.09.03 N 170. So, in accordance with clause 4.2.1.1 of the Rules and Norms of Technical Operation, to It is also the responsibility of the company to repair various damage to the walls, immediately after they have occurred, in order to prevent their expansion. This fully applies to the decoration of walls or ceilings (plaster, facing tiles, and so on) - clause 4.2.1.5.

The next step is to putty the walls for painting.

At this stage, irregularities and small cracks are rubbed, and a waterproofing layer is applied.

After the putty is finished and the facade dries up a little, the craftsmen proceed to the priming stage. A high-quality primer is a guarantee of the durability of the facade painting. It is the primer that ensures the maximum adhesion of the paint to the wall. If this stage is ignored, the paint consumption will be very high, and the paint itself will be washed off the facade very quickly. A layer of primer will never interfere with any, even the most superficial cosmetic work on the facade: primer mixes increase the strength of the putty and plaster. Only after the ground layer will the facade paint delight you with its bright color for a long time, and the facade itself will be resistant to atmospheric precipitation.
